Bajaj Allianz General Insurance Company Limited v. Muniya & ORS
IN THE HIGH COURT AT CALUTTA
Civil Appellate Jurisdiction 13.01.2023 SL No.1 Court No. 654 Ali F.M.A. 2548 of 2014 IA No: CAN/1/2014 (Old No.:CAN/7089/2014) CAN/2/2019 (Old No.:CAN/7814/2019) Bajaj Allianz General Insurance Co. Ltd.
Vs.
Muniya & Ors.
Mr. Rajesh Singh ...for the appellant-Insurance Co.
Mr. Ashique Mondal ......for the respondents-claimants.
This matter is appearing under the heading "To be mentioned".
Both learned advocate for appellantinsurance company as well as respondentsclaimants submits that the appeal was disposed by Lok Adalat on 11.12.2021. However due to mistake in the appeal number the matter was once again placed before Lok Adalat on 13.8.2022 for correction. The appeal number was corrected by order dated 13.8.2022, however once again another mistake crept into the said order mentioning respondents as appellants.
They submit for appropriate order.
Inadvertent typographical mistake has crept into order dated 13.8.2022 of the Lok Adalat mentioning "respondent no.3" as "appellant no.3" in 5th line, 7th line and 8th line of 1st page respectively.
Further in 9th line of 1st page "respondent no.1 and 2" has been mentioned as "appellant no.1 & 2". Further in the 1st line of 2nd page "appellant no.1" has been mentioned instead of "respondent no.1". The words "appellant no.3" appearing in 5th line, 7th line and 8th line of 1st page be read as "respondent no.3" and the words "appellant no.1 & 2" in the 9th line of 1st page be read as "respondent no.1 & 2". Further the words "appellant no.1" in the 1st line of 2nd page be read as "respondent no.1" Other portions of the said order shall remain unaltered.
