1. This revisional application has been filed for expeditious disposal of the proceeding pending in connection with Singur Police Station Case No.243 of 2022 recorded G.R. Case No.954 of 2022 under Sections 498(A)/406 of the Indian Penal Code read with Section 4 of the DV. Act.

2. It is submitted on behalf of the petitioner that the proceeding is pending since 2022 and since thereafter, long dates are given for appearance and because of any other reason, the matters are being adjourned resulting the inordinate delay in the proceedings, which is causing severe prejudice to the petitioner.

3. In support of such contention, learned advocate has filed the certified copy of the orders passed by the learned Trial Court.

4. Heard the submission and perused the materials on record and the order-sheets, which reveals that on March, 2023, the record was transferred from the Court of learned A.C.J.M. and the date was fixed for appearance on 10th March, 2023. Since, thereafter, several dates are passed, however, the charge was not framed.

5. Further, it transpires that not any of the occasion, all the four accused persons appeared before the Court and the same is found to be recorded in the order-sheets of the learned Court.

6. It is undisputed that the date is given for appearance after a long gap of more than six to seven months for appearance and consideration of charge.

7. From the above factual aspect, negligence on the part of the accused persons to appear before the Court on the same date is apparent.

8. However, since the proceeding is pending since 2022, the learned Court is directed to make all endeavour to proceed with the case after giving dates at reasonable interval and to frame the charge on the next date when the matter is fixed for appearance and consideration of charge subject to the condition that all the four accused persons are present before the Court on the said date.

9. With this above observation/direction, revisional application stands disposed of.

10. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.

11. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities. (CHAITALI CHATTERJEE (DAS), J.)
