Petitioner complains that he is unable to enter at his residence situated within the jurisdiction of Monteswar Police Station.

Affidavit of service so filed be kept with the record.

Report submitted by the state reflects that there are criminal cases pending between the petitioner and the private respondent. However since the petitioner complains that he is unable to stay at his residence because of that act and activities of the private respondents, I direct the petitioner would approach the Officer-in-Charge, Monteswar Police Station with his epic card, the Officer-in-Charge will assess regarding genuinity of the address specified in

the epic card, conduct a local enquiry as to whether the petitioner was earlier staying and has been forced to live his own house because of the attending circumstances at the behest of the private respondents. In case the Officer-in-Charge finds that the petitioner was earlier staying and has been forced to stay outside and the petitioner expresses his desire to enter his residence, under such circumstances, the Officer-in-Charge will depute police personnel to ensure smooth entry of the petitioner at his residence and subsequently keep a vigil for a considerable period of time to ensure that no breach of peace or tranquility takes place if the petitioner enters his residence subsequent to the satisfaction of the Officer-in-Charge, Monteswar Police Station.

With the aforesaid observations WPA 19764 of 2023 is disposed of.
