Petitioners are directed to serve a copy of the revisional application upon Mr. Imran Ali, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course.

The subject matter of challenge relates to Bally Police Station Case No. 35 of 2023 dated 26.03.2023. Mr. Dutta Gupta, learned advocate for the petitioners submits that the present petitioners are the father-in-law and mother-in-law against whom hardly there are any allegations. Prima facie, I find that in the FIR and the chargesheet there are allegations and the documents under Section 207 of the Code of Criminal Procedure are yet to be supplied to the petitioners for assessing and scrutinizing regarding their complicity in the background of the case.

Thus, I am of the opinion that the revisional application is

premature. Petitioners would be at liberty to approach this court after receipt of the documents under Section 207 of the Code of Criminal Procedure or after exhausting the statutory procedure before the learned Magistrate.

With the aforesaid observations, the present criminal revisional application being CRR 3072 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
