The petitioner is an Assistant Teacher at Manora High School, Goalpokhar-II, District- Uttar Dinajpur of the subject ''Bengali'.

The petitioner is praying general transfer on the grounds that the school is a Urdu Medium school and there is no student of the subject Bengali and the distance between the school and his residence is more than 166 Kms.

Learned Counsel for the State files instruction bearing Memo No. 1639/D.I/ S(S.E)UD/Law dated November 23, 2011 which he has received from the District Inspector of Schools (S.E), Uttar Dinajpur, the respondent no. 4 herein. The said instruction is taken-on-record.

It appears from the said instruction that there are sufficient number of students of the subject

Bengali in different classes of the school. The ground of distance is not very convincing for consideration of his application for general transfer. W.P.A. 19768 of 2023 is therefore dismissed, there shall be however no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
