It appears that the application for condonation of delay was allowed on July 6, 2023 and the stay application along with the appeal was fixed on August 2, 2023. 3.

It appears from the impugned order dated September 17, 2021, the order of injunction was made operative till November 26, 2021.

In the order dated January 31, 2022 it was recorded that the injunction application was fixed on February 4, 2022. We dispose of the appeal by directing the learned trial court to dispose of the injunction application (Misc. Case No.1666 of 2021), if pending, preferably within eight weeks from the date of communication of this order.

The learned Registrar (L & OM) is directed to communicate this order to the learned Judge, VIIIth Bench, City Civil Court at Calcutta within one week from date.

However, views expressed shall not influence the learned trial Judge in disposing of the application on

merits after giving reasonable opportunity of hearing to the parties.

Prima facie, we do not find any reason to interfere with the order passed by the learned trial Judge.

Accordingly, the appeal and the connected application are disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on an urgent basis upon compliance of usual formalities.
