Dayal Halder And ANR. v. State Of West Bengal
19.09.2025 Court No.28 Item No.30 ssi CRM (A) 3036 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Raghunathganj Police Station Case No.834 of dated 24.06.2025 under Sections 61 (2)/ 103 (1)/3 (5) of the BNS, 2023. And In the matter of: Dayal Halder & another.
....Applicants/Petitioners Mr. Kingsuk Mondal ...for the petitioners Mr. Koushik Kundu Mr. Akash Ganguly ..for the State Heard the learned counsels for the petitioners and the State. Perused the case diary.
The prosecution case is that the petitioners offered to take the victim to the hospital where her husband was admitted. Thereafter without any explanation, the victim was taken to a hospital after she had consumed/was administered poison. The family members of the victim were notified only on the next date.
Considering the incriminating materials available in the case diary including the non-explanation about the circumstances by the petitioners to the relatives of the victim and the fact that investigation is going on, I do not consider this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail of the petitioners is rejected.
