Mr. Dibashis Basu Ms. Megha Datta Ms. Anushka Ghosh ...for the petitioners Mr. Srijan Nayak Mr. Atish Kumar Biswas ...for Kolkata Municipal Corporation It appears that the Corporation had issued a notice under Section 401 of the Kolkata Municipal Corporation Act, 1980 against the petitioner for an alleged unauthorised construction at premises no.5, Weston Street, Police Station-Bowbazar, Kolkata700013. Subsequently, as per order of the Director General (Building) dated September 26, 2024, the said notice had been withdrawn.

Thereafter, the Assistant Engineer (Civil), Building Department, Borough-VI intimated the Officer-in-charge of Bowbazar Police Station to take necessary steps to drop the proceedings initiated under Section 401 (A) of the Kolkata Municipal Corporation Act, 1980 based on the complaint lodged by the Corporation.

In view of the aforesaid, no further order needs to be passed in this writ petition.

The Officer-in-charge, Bowbazar Police Station shall act on the basis of the communication dated September 26, 2024, issued by the Assistant Engineer (Civil) within a period of two months from date. Accordingly, WPA 20360 of 2024 is disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
