Criminal Revisional Jurisdiction 24-08-2023 Subha D/L 13 Ct no.34 CRR 3074 of 2023 Ruban Mohanasundaram -versus- The Union of India Mr. Angshuman Chakraborty ....for the petitioner.
Mr. Chakraborty, learned advocate for the petitioner submits that only one witness is left for being completed. Learned advocate also points out that the Narcotic Control Bureau happens to be the Investigating Agency who initiated the present case being NCB Crime No. 43/NCB/KOL/2016, pursuant to which the learned special court was pleased to renumber as N 211/2016. Learned advocate has also submitted that the petitioner is unnecessarily suffering, as allegedly he is a person of foreign origin. The learned trial court is directed that if only one witness has been left for examination by the prosecution, the learned special court would inform the Zonal Director of the Narcotic Control Bureau so that the witness who has been left out for the being examined be made available before the learned trial court on the next date so fixed and steps be taken so that the trial of the case is concluded, at least the prosecution witnesses are completed within a period of three months from date. The learned trial court would thereafter conduct the examination of the accused under Section 313 of the
Code of Criminal Procedure, afford opportunity to the accused who adduced evidence and thereafter take steps so that the arguments of the case are heard and the case is finally disposed of by 31st July, 2024.
With the aforesaid observations, the present criminal revisional application being CRR 3074 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
