Ms. Nupur Chaudhuri Mr. Sahil Hamid ... for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 6th Court at Alipore to dispose of Title Suit No. 174 of 2001 expeditiously.

The learned advocate appearing for the petitioner submits that the injunction application is yet to be disposed of.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties.

However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing the opposite parties before the learned trial judge.

From the order dated 3rd March, 2025 it appears that the petitioner was directed to take steps upon the death of one of the defendants.

On a query of the Court the learned advocate appearing for the petitioner submits that necessary

steps have not yet been taken with regard to the death of the said deceased defendant.

In view thereof, this Court is not inclined to pass any direction for expeditious hearing at this stage. With the above observations, C.O. 3120 of 2025 stands disposed of.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
