1. Heard learned advocates for the parties.

2. Learned counsel for the State has handed over a report prepared by SI, Amal Kumar Chandra, Daulatabad PS, Murshidabad PD, as called for by this court.

3. From the report, as submitted by the IO, it reveals that the present petitioners proposed the complainant to make her member of a society which, according to the accused persons, is an organisation of a central government and, thus, persuaded the informant and other 12 persons to collect money for them from different persons and thereafter the said persons including the informant collected money from 1611 number of persons @ Rs.860/- in the account of the petitioner no.1.

4. From the report, as filed before this court today, we also find active participation of the petitioner no.2 who is the wife of the petitioner no.1 in the alleged crime.

5. Considering the seriousness of the crime, and the role played by the present petitioners in the alleged crime, we are not inclined to exercise our discretion under Section 438 Cr.P.C. in favour of the petitioners.

6. Accordingly, the prayer for anticipatory bail is rejected.

5. CRM(A) 3607 of 2023 is dismissed.

6. Interim protection as granted by this court on 1st September, 2023 stands recalled.
