The main grievance of the petitioner was in respect of the incident of July 31, 2025.

It has also been complained that certain miscreants along with the private respondents attacked her and her son with deadly weapons.

Consequent to which, they fell down and received injuries.

The petitioner is also aggrieved by the fact that isnpite of receipt of such information, no steps were taken by the

Mandir Bazar Police Station.

State has submitted a report which reflects that a proceeding under Section 126 of the BNSS has been drawn against the private respondents and others.

Having considered that the police authorities have restrained themselves in view of the background of the civil suit pending, I am of the opinion that they have acted in consonance with law.

Further, it is reflected from the report that the petitioner could not furnish any injury report and only named the hospital. The hospital authorities were examined particularly the Naiyarat Rural Hospital wherefrom it was informed that no injury report was found in the name of the petitioner and her son.

Having considered that the police authorities, to that effect, have enclosed the documents, I grant liberty to the petitioner to approach the jurisdictional

Magistrate under Section 175(3) of the BNSS. The learned Magistrate would, in such circumstances, pass necessary directions as he/she deems fit and proper after assessing and/or ascertaining the genuinity of the accusations.

It is further directed that in case the petitioner faces inconveniences, she would report to the police authorities afresh and the police authorities would definitely, at that stage, take prompt steps in accordance with law.

With the aforesaid observations, WPA 19730 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
