Mr. Arpan Kundu ..for the petitioners Mr. Lalratan Mondal Mr. Dilip Kumar Sadhu ..for the Private respondents It is the case of the petitioners that their father was the owner of a shop room at 36 (15/D) West Dhangar Para, North 24 Parganas, Kolkata-700 122. After the death of their father, Barrackpore Municipality transferred the trade licence in favour of respondent nos. 6 to 8 behind the back of the petitioners. Respondent nos. 6 to 8 are brothers of the petitioners.

I am of the view that this writ petition need not be kept pending.

Accordingly, this writ petition is disposed of with a direction upon the Municipality to convene a hearing giving a due notice to the petitioners, and respondent nos. 6 to 8 to consider the grievance of the petitioners.

After hearing the parties, the Municipality shall pass a reasoned order with regard to the issuance of the trade licence in respect of the shop in question. The entire exercise shall be completed within a period of three months from the date of communication of this order.

Accordingly, WPA 19802 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
