The petitioner claims that he has been thrown out of his house by his son and wife since after he gifted certain properties to them.
Counsel for the private respondent son submits that the petitioner has now changed his mind and is acting at the instance of his daughter. There is suit being TS 257 of 2021, pending before the Learned Civil Judge (Junior Division), Lalbagh, Murshidabad between the petitioner and the private respondents in which a status quo has been ordered.
Learned counsel for the State has produced a report in the form of instructions dated 3rd January 2022, issued by the Officer-in-Charge, Ranitala Police Station addressed to the learned State Advocate and the same is taken on record.
The Officer-in-Charge, Ranitala Police Station shall escort back the writ petitioner to his house and suitable warning shall be given to the private respondent son and wife. It shall also be ensured by the Officer-in-Charge, Ranitala Police Station that the petitioner is able to live at the said premises peacefully. The Officer-in-Charge, Ranitala Police Station shall maintain a strict vigil over the area and shall immediately attend to any complaint from the petitioner as regards any threat to their life and person. It is also made clear that since the private respondents have not used any affidavits, the allegations made in the writ petition shall not be deemed to have been admitted by them.
With the aforesaid observations, the writ petition is disposed of.
There shall be no order as to costs.
