The wife/respondent of the Matrimonial Suit No. 181 of 2018 filed by the husband/opposite party seeking dissolution of marriage between the parties by a decree of divorce is the petitioner of the present application under Section 24 of the Code of Civil Procedure.

The said matrimonial suit is pending before the learned Additional District Judge at Katwa, District- Purba Burdwan.

The petitioner by the present application is praying withdrawal of the said suit from the Court where it is now pending and transfer of it to the Court of the learned Additional District Judge at Bolpur, District Birbhum.

Mr. Hossain, learned advocate appearing on behalf of the husband/opposite party submits that his client although is not opposing the prayer of the petitioner, but he is anxious about delay in disposal of the said suit.

In view of such stand of the respondent/opposite party, the Matrimonial Suit No.

181 of 2018 be withdrawn from the Court of the learned Additional District Judge at Katwa, DistrictPurba Burdwan and be transferred to the Court of the learned Additional District Judge at Bolpur, District-Birbhum.

The parties shall appear before the learned Additional District Judge at Bolpur, District Birbhum on September 30, 2021 on the basis of the server copy of this order, irrespective of transmission of the records of the said matrimonial suit to the said transferee Court.

The transferee Court shall act on such communication.

The transferee Court shall proceed to dispose of the said suit from the stage where it has already reached and shall make all endeavour to dispose of the matrimonial suit expeditiously in accordance with law.

C.O. 3296 of 2019 is thus disposed of with the above terms without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
