Mr. Tapas Kumar Majumder ....for the petitioner Dr. Sutanu Kumar Patra Ms. Supriya Dubey ...for the SSC Mr. Gourav Das ...for the State Petitioner participated in 7th Regional Level Selection Test, 2006 ( for short, 'RLST 2006') for the post of Assistant Teacher in Physical Education under pass category in Bengali Medium. The grievance of the petitioner which has been ventilated by instituting this writ petition is below ranked candidates who were awarded lesser marks than the petitioner were recommended for being appointed in the post of Assistant Teacher in Physical Education ignoring the merit position of the petitioner in the select list.

The matter has been heard on number of occasions and pursuant to the order passed by a coordinate Bench on 7th September, 2007 this Court directed the learned advocate for the West Bengal Central School Service Commission to produce the relevant records relating to 7th RLST 2006 for appointment of Assistant Teacher in Physical Education in Bengali Medium under pass category. Today, the learned advocate for the Commission

has produced copies of relevant records which reveal that there were 12 vacancies for the post of Assistant Teacher in Physical Education under pass category, Bengali Medium. For filling up those 12 vacancies of Assistant Teacher in Physical Education a panel of 12 candidates was prepared and as per norms a wait list containing 3 candidates was also made ready. A copy of the wait list is produced before this Court from where it appears that the last wait listed candidate secure 53.66 marks whereas petitioner obtained 52.83 marks. The relevant part of the merit list prepared by the Commission is also produced before this Court. From the aforesaid facts it appears that considering the marks obtained by the petitioner she did not come within the zone of consideration for being recommended in the post of Assistant Teacher in Physical Education under pass category.

Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs. Copies of wait list and relevant part of the merit list containing name of the petitioner which are filed before this Court today are taken on record.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
