Applicant/Petitioner Ms. Shalini Bairagi Mr. Priyankar Ganguly ...for the petitioner Mr. Jaydeep Biswas Mr. Abhishek Verma ..for the State Learned counsel appearing on behalf of the petitioner submits that charge sheet has been submitted as against the petitioner and there is no other incriminating materials except for the statements of the co-accused which is inadmissible in evidence.

Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that from the seizure list and the statements of local witnesses, it would appear that heroine was being prepared in the house of the petitioner. Several co-accused were apprehended with the heroine in his house. The petitioner had fled away from his house. Considering the above, the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
