23.
Ct.No.28 as (Rejected) C.R.M. (DB) 3257 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Ranaghat P.S. Case No.332 of 2019 dated 12.10.2019 under Section 302 of the Indian Penal Code read with Sections 25/27 of the Arms Act. In the matter of : Madhab Das & Anr.
... Petitioners.
Mr. Navanil De, Mr. Subhrajit Dey, Ms. Monami Mukherjee.
...for the Petitioners.
Mr. Madhusudan Sur, ld. A.P.P., Mr. Dipankar Paramanick.
...for the State.
1.
Petitioners renew their prayer for bail. It is submitted inspite of direction given by this Court, charge has not been framed. They pray for bail.
2.
Learned Advocate for the State opposes the bail prayer. He submits report. He contends delay in the matter is due to vacancy in the trial court.
3.
We have considered the materials on record. There are ample materials connecting the petitioners with the murder. Their bail prayer had been rejected earlier on a number of times on merits. Delay in the matter is due to vacancy in the trial court.
4.
Under such circumstances, we are not inclined to grant bail to the petitioners at this stage.
5.
Accordingly, the prayer for bail of the petitioners is rejected.
