The subject matter of the application relates to acquittal under the provisions of Section 138 of the Negotiable Instruments Act. The same has been filed within time.

Having regard to the issues raised by the present petitioner, it is held that the petitioner must be granted an opportunity to prefer the memorandum of appeal before this Court. Let the memorandum of appeal be filed within a period of 30 days from date.

Accordingly, CRMSPL 59 of 2022 is allowed.
