Mr. Bhaskar Prasad Vaisya, AGP Mr. Mrinal Kanti Ghosh ..for the State The petitioner applied for the post of 'Karmabandhu' at Gushkara Mahavidyalaya, Purba Bardhaman.
It is the grievance of the petitioner that for long two years the college authority did not take any step to fill up the post after he had made the application. The petitioner prays for a direction upon the college to complete the selection process.
The college has filed a report.
The learned advocate appearing for the college submits that due to Assembly Election, 2021 the
college could not proceed with the recruitment process. Thereafter the Higher Education Department of the State has introduced a memo dated January 5, 2022 whereby the power to appoint a non-teaching staff has been vested in the College Service Commission. Therefore, the recruitment process could not be concluded.
Merely by applying for any post a candidate does not acquire any vested right against such post. It is a settled law that the appointing authority is at liberty to abandon a selection process at any stage for any justifiable reason. The action of the college does not call for any interference.
Accordingly, WPA 19813 of 2023 is dismissed.
