This instant revisional application is directed against the Order dated 06.06.2024 by which the learned Judicial Magistrate, 3rd Court, Tamluk, Purba Medinipur was pleased to reject the prayer of the petitioner under Section 311 of the Cr. P.C and fix the case for argument.

As the petitioner failed to appear before the learned trial court warrant of arrest was issued against the petitioner in the meantime. Learned advocate for the petitioner submits that he is not willing to proceed with the main application but an opportunity be granted to surrender before the learned trial court and obtain bail and participate in the proceeding. Upon hearing the learned advocates and upon considering the facts of the case, this court is of the view that in the interest of justice, the petitioner should be granted an opportunity to appear before the learned trial court and participate in the proceeding. Thus, the petitioner is granted opportunity to appear before the learned trial court on or before 12th December, 2025.

In the event, the petitioner appears before the learned trial court within this period the earlier order dated 03.11.2025 issuing the warrant of arrest will stand recalled and the petitioner will be permitted to continue on the earlier bail. However, in the event, the petitioner fails to appear on or before 12.12.2025 the learned trial court will be entitled to proceed in accordance with law. The warrant of arrest issued on 03.11.2025 shall remain stayed till 12.12.2025.

The certified copy of the order sheet dated 03.11.2025 be kept with the record.
