A direction to secure expeditious disposal of Title Suit No. 9708 of 2012 pending before the learned Civil Judge (Senior Division), 10th Court, Alipore, is the ultimate relief sought for in this case. The only contention expressed by the petitioner is against the delay caused in the disposal of case, due to the long pendency of the interlocutory applications remaining un-disposed of as yet. No other point is raised requiring address by this Court.

In view of the nature of the order proposed to be made in the case, no prior notice is considered to be necessary.

Service upon the opposite parties is thus dispensed with.

Accordingly, learned Civil Judge (Senior Division), 10th Court, Alipore in Title Suit No. 9708 of 2012 is requested to ensure expeditious disposal of the suit, referred hereinabove, after causing disposal of the interlocutory applications, providing sufficient

opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.

While endeavouring such exercise, the year of institution of the suit may be taken into account, and the Court below may proceed to dispose of the case in a faster mode, so that there could be logical conclusion of the suit reached within a reasonable period of time.

This would not, however, prevent the Court below to take up the application for amendment, and any other applications, one after another within six weeks after reopening of Puja vacation of the Court below.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
