Petitioner Mr. Kalidas Saha ... ... for the petitioner Mr. Ranadeb Sengupta ... ... for the State It is submitted on behalf of the petitioner that he is in custody for about 315 days. It is further submitted raid was conducted at his residence but no recovery was made. Subsequently, he has been falsely implicated in the instant case.

Learned advocate appearing for the State opposes the prayer for bail and submits 62 gms. of Yaba tablets was recovered from the possession of the petitioner. Petitioner carries on trade in narcotic substance in collusion with co-accuseds from whom other recoveries were made.

We have considered the materials on record. From coaccuseds recovery of narcotic substance was made. Subsequently, 62 gms. of Yaba tablets were recovered from the petitioner. In view of the aforesaid materials on record and the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is thus rejected.

Trial court is directed to expedite the trial and conclude the same at an early date.
