The petitioner seeks compassionate appointment. It appears from the communication made by the Chairman, Baidyabati Municipality on March 26, 2018 addressed to the mother of the petitioner i.e. the widow of the deceased employee that her name has already been enrolled in the roll meant for compassionate appointment.

The petitioner thereafter filed a writ petition being WP 5054 (W) of 2018 which stood disposed of by this Court on July 11, 2018. The petitioner relies upon a judgment delivered by the Hon'ble Division Bench in MAT 859 of 2018 with CAN 6137 of 2018 (Debabrata Tiwari v. The State of West Bengal & Ors.) An appeal has been carried from the judgment passed in the matter of Debabrata Tiwari (supra).

It has been submitted by the learned advocate representing the State respondents that the Hon'ble Supreme Court has been pleased to direct stay of operation of the direction passed in Debabrata Tiwari (supra).

As it appears that the name of the mother of the petitioner has already been empanelled in the roll meant for compassionate appointment, accordingly, no further relief can be granted to the petitioner in the present writ petition.

The writ petition stands disposed of.
