Petitioner participated in the selection process for being engaged as Anganwadi Helper by submitting application declaring herself as candidate belongs to OBC.

At the time of selection process petitioner was asked to submit OBC certificate in support of her claim to be considered as OBC candidate which she failed to submit as a result whereof petitioner was not selected for being engaged as Anganwadi Helper. Report in the form of affidavit was filed on the last occasion by the Child Development Project Officer, Balagarh Integrated Child Development Project which was affirmed on 22nd February, 2024 wherein at page 13 the application of the petitioner has been annexed. However, such application does not accompany OBC certificate.

Today, the learned advocate representing the petitioner submits that she has decided not to use an

exception to this report since the contention made on behalf of State-respondents by filing aforesaid report cannot be controverted.

In view of aforesaid submissions made on behalf of the petitioner the writ petition stands dismissed. There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
