Samir Mondal v. State Of W.B.
05.01.2021 Item No. DL 10 Ct. No.1 AD & Saswata WPA 19085 of 2005 (Through video conference) Samir Mondal -vsThe State of West Bengal & ors.
Mr. Rana Mukherjee Md. Sabir Ahmed, Advocates ... for the State present in Court The writ petition was filed in the year 2005 praying for issuance of a writ in the nature of Habeas Corpus seeking production of Lakshimi Rani Mondal, who had allegedly gone missing. The petition filed more than a decade back is pending since then. It was last listed in Court on 05.10.2005 and has not been pursued by the petitioner or his counsel thereafter. Apparently, he has lost interest or the grievance raised in the writ petition stands settled. From the pleadings it is evident that an FIR was also registered on 26.06.2005. Investigation therein must have been completed after following due process of law.
Hence, nothing survives in the writ petition to be adjudicated upon at this stage.
Accordingly, the writ petition is dismissed.
