CRR 2639 of 2021 In the matter of:- Smt. Sumitra Pradhan & Ors. Mr. Manik Lal Poddar .....for the petitioners Mrs. Ratna Ghosh .....for the State This is an application seeking an expeditious disposal of a proceeding in which a charge-sheet was submitted under Sections 323 and 341 read with Section 114 of the Penal Code.
Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the accused in this case while the opposite party no. 2 is the de facto complainant. Although the FIR was lodged in 2015 and the charge sheet was submitted in 2016, till date the proceeding could not be concluded and not a single witness has been examined in this case. The plea was recorded in 2016 itself. Thereafter on several dates, adjournments were granted. In fact, on one occasion a warrant of arrest had to be issued against the de facto complainant. She thereafter joined the proceeding. However, the proceeding has remained pending for no fault of the present petitioners.
Learned counsel for the State submits that the State would not come in the way if a direction is passed
to expedite the trial.
I have heard the submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition. It appears that some delay has been occasioned in this case, especially considering the fact that the FIR was lodged in 2015 and the plea was recorded by 2016. In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of one year from next date of hearing.
With these observations, the revisional application is disposed of.
