Versus

Mrs. Saila Afrin Mr. Rafat Jahan ..for the Petitioner Mrs. Sukanya Datta ....for the State Affidavit of service filed by the petitioner and report submitted by the State are taken on record. Heard learned counsels for the parties.

Learned counsel for the petitioner submits that the petitioner was arrested in connection with the criminal proceedings and was in custody for about four months. During such period the private respondents who are his brother, closed relatives and local people put his house under lock and key and after his released from custody, he and his wife are not being allowed to enter the house or reside therein. Every time the petitioner tried to enter his house, he was driven out by the private respondents. The petitioner seeks police assistance to return to his house.

Learned counsel for the State submits that there are several criminal cases pending between the parties and charge sheets have been submitted in some of them.

Since the petitioner intends to return to his house and stay therein, he shall approach the local police authority and intimate the date and time of his return. The police authority shall render necessary assistance to him so that he is able to return to his house and stay therein peacefully and without any hindrance from any corner. The police shall keep strict vigil in the area in order to avoid any untoward incident and to ensure maintenance of peace and tranquility.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
