The revisional application was preferred challenging the proceeding arising out of Taldanga Police Station Case No. 113 of 2011 dated 28.11.2011 under Sections 143/323/325/326/506 of the Indian Penal Code and Section 3 of the Scheduled Caste and Scheduled Tribe (Prevention and Atrocities) Act, 1989. The revisional application reflects that the subject matter of challenge was in respect of the First Information Report so registered with the concerned Police Station.

Mr. Saryati Dutta, learned advocate appearing for the State has submitted a report. Report reflects that on conclusion of investigation charge-sheet has been filed before the jurisdictional Court.

Having regard to the change of circumstances since the revisional application was preferred I am of the considered opinion that the present revisional application and its prayers are not further maintainable.

The application being CRR 2678 of 2012 is dismissed. However, the petitioner would be at liberty to agitate the points canvassed in the revisional application at the stage of consideration of charge before the jurisdictional Court.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
