The husband in a suit filed under the Hindu Marriage Act for a decree of nullity thereby annulling the marriage between the parties has filed the instant application under Article 227 of the Constitution of India challenging two orders in connection with Matrimonial Suit No.18 of 2014 pending before the learned Additional District Judge, 6th Court at Alipore.

Since the examination of the Doctor did not commence, the petitioner felt aggrieved and filed the present Civil Orders.

When the matter is taken up for hearing, the learned advocates appearing for the respective parties uniformly submitted that the evidence of the Doctor through Videoconferencing has already started. The further evidence of the said Doctor was stalled due to the pandemic. The petitioner now prays for a direction upon the learned court below to dispose of the matrimonial suit expeditiously.

This Court is informed that the evidence of the witnesses and final hearing of the suits pending before the learned Courts have already started.

I hope and trust that the learned Additional District Judge 6th Court at Alipore will make endeavour to dispose of the Matrimonial Suit No.18 of 2014 as expeditiously as possible and preferably within a period of one year from the resumption of normal functioning of the Court without granting any unnecessary adjournment to either of the parties.

CO No.3311 of 2019 is disposed of without any order as to costs.
