In Re: CAN 2 of 2025 The learned advocate representing the appellants/claimants had filed an application being CAN 2 of 2025 after disposal of the instant appeal which inter alia stated that the appellant No.5 i.e. Anika Barman being the mother of the deceased had expired on 21st November, 2020 supported by a copy of the death certificate. However, the demise of appellant No.5 was not to the knowledge of the learned advocate representing the appellants/claimants after disposal of the instant appeal and the same is allowed. Department is to take note of the same and expunged the name of appellant No.5 from the cause title of the memo of appeal. The judgment and order dated 12nd February, 2025 be modified to the extent of the compensation be equal proportion amongst four remaining claimants who had been the legal heirs of appellant No.5 since deceased.

The application being CAN 2 of 2025 is disposed of. Copy of the order be sent to the Department and office of the learned Registrar General, High Court at Calcutta for immediate compliance.
