Petitioner has made an application for mutual transfer and the school where petitioner is presently serving has given no-objection on 18th July, 2024 for consideration of the transfer application by the appropriate authority. The mutual transfer, if allowed, is to be effected in between the petitioner and the respondent no. 8. Respondent no. 8 is also represented by learned advocate.
The mutual transfer application was forwarded to the West Bengal Central School Service Commission on 24th July, 2024 for taking necessary decision. The petitioner prays for a direction upon the Chairman of
the Commission to decide mutual transfer application.
Respondents, including the West Bengal Central School Service Commission, are represented by learned advocates. It is submitted that if the Chairman is permitted to decide the mutual transfer application in suspension of Utsashree portal, the decision can be taken on the said application in accordance with law.
Having considered the submissions made on behalf of the parties the writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission, being respondent no. 3, to decide the mutual transfer application of the petitioner and the respondent no. 8 by 12 weeks from the date of communication of this order. The decision to be taken by the respondent no. 3 shall be communicated to the petitioner and the respondent no. 8 by one week thereafter.
There shall be no order as to costs.
Urgent photostat certified copies, if applied for, be issued to the parties on compliance of requisite formalities.
