Petitioner(s) Mr. Satadru Lahiri Mr. Syed Wasim Faruque ... for the Petitioner(s) Mr. Saibal Bapuli Mr. Karan Bapuli ... for the State-respondent(s) A verification report has been submitted from Gotra Gram Panchayat wherefrom it reflects that Chandrani Sarkar wife of Sukumar Sarkar is a permanent resident of Village Dandirhat and she has been residing at the said address along with her husband for the last 28 years. The report also speaks that the petitioner has two sons one Abhijit Sarkar and one Prikhhid Sarkar.
Learned advocate for the State opposes the prayer for bail.
Having considered the period for which the petitioner has been residing and, is presently faced with the case under section 14A(b) of the Foreigners Act along with Section 12 of the Passport Act as also taking into account
the fact that the local representatives have vouched for the petitioner, I am of the view that further detention of the petitioner is unwarranted on the basis of the report submitted by the investigating officer of the case. Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, the petitioner viz, Chandarani Sarkar @ Chanda Rani @ Sanda Rani shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned ACJM, Basirhat.
If on bail, the petitioner shall make herself physically available on each and every date so fixed by the learned trial court and shall not leave the jurisdiction of district of 24 Parganas (North) without prior intimation to the learned trial court.
Accordingly, CRM(M) 1485 of 2025 is allowed.
