The grievance of the petitioner is that despite having written to the respondent authorities, the Distribution Company, that is, WBSEDCL is bent upon giving a new electric connection to a submersible pump at the behest of respondent no.8.
Learned counsel submits that the locality where such connection has been sought is a 'semi-critical' area insofar as the ground water resources are concerned and, without any permission from the ground water authorities, the Distribution Company cannot give any such connection to any applicant.
In view of the innocuous nature of the order proposed to be passed, no further service of notice on the respondents is deemed necessary.
WPA 20936 of 2021 is disposed of by directing respondent nos.5 and 6 to mandatorily consider the present writ petition as a representation of the petitioner and to decide on the same prior to giving any new electric connection to respondent no.8.
The respondent authorities and all the parties shall act on the written communication of the learned advocate appearing for the petitioner, coupled with a server copy of this order, without insisting upon prior production of a certified copy, for the purpose of compliance of this order. The purported communication dated October 4, 2021 by the Geologist, SWID & Member Secretary, District Level Ground Water Resources Development Authority to the AE & Station Manager, Mongolkote Customer Care Centre, WBSEDCL filed in court today be kept on record.
There will be no order as to costs.
Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
