Petitioners apprehend that the private respondents would encroach and grab the property of the petitioners and to that effect information was furnished to the Officer-in-Charge, Panskura Police Station. The information which was furnished was on 03.05.2025 which reflects that in spite of settlement having been entered into between the petitioner and respondent nos.

& 5, the respondents surreptitiously dismantled the Mango trees and refused to respect the settlement.

The respondents threatened of dire consequences and in spite of informing the Forest Department no steps have been taken.

Learned advocate for the State has submitted a report. Report reflects that a long standing dispute is existing between the petitioner

and the private respondents. Police authorities are well aware regarding the dispute as the parties have approached the Executive Magistrate also.

However, apprehending that the strained relationship between the petitioner and the private respondents may violate the peace and tranquility of the locality, proceedings have been drawn up under section 126 of the BNSS. Police authorities as such would oversee that there is no further violation so far as the law and order is concerned. It is additionally directed that in case over the issue relating to land there is any dispute, the right, title and interest of the same should be addressed before the Civil Court and if there are specific directions from the Court concerned, police authorities would address the same in accordance with law.

With the aforesaid observations WPA 19860 of 2025 is disposed of.

Report submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
