Having heard the learned counsel for the parties as well as the State authority it appears to me that the writ petitioner may be granted a leave to file afresh.

Accordingly, the instant writ petition be disposed of with a direction to the writ petitioner to file afresh on the basis of self-same cause of action according to the law.
