By this writ petition, petitioner has challenged the impugned order dated 28th July, 2023 passed by adjudicating authority on the ground of violation of principle of natural justice by not providing opportunity of personal hearing to the petitioner in spite of specifically asking for the same.

Mr. Siddiqui, learned Additional Government Pleader fairly submits that it does not appear from record that the request made by the petitioner for personal hearing was considered.

Considering the facts and circumstances of the case, the aforesaid impugned order dated 28th July, 2023, is set aside and the matter is remanded back to the adjudicating authority concerned to pass a fresh speaking order in accordance with law after giving an opportunity of personal hearing to the petitioner within a period of four weeks from the date of communication of this order.

With this observation and direction, this writ petition being WPA 19862 of 2023 is disposed of. ( Md. Nizamuddin, J.)
