The relevant college namely, Kalna College in Purba Bardhaman sought to fill-up five 'Group - C' posts by an advertisement dated September 18, 2017. It is not in dispute that the petitioner was successful in the selection process and the Governing Body of the College sent the panel containing the name of the petitioner before the Director of Public Instruction, West Bengal by a letter dated June 27, 2018, for approval.
The Director of Public Instruction did not approve the said panel which compelled the petitioner to file this writ petition before this Court. It appears that the panel in question has been ultimately approved by the Director of Public Instruction, West Bengal by a memo dated September 26, 2023.
The learned advocate appearing for the college has made over a copy of the said memo dated September 26, 2023, to this Court.
Let the copy of the said memo be kept with the records.
Since the panel in question has been approved by the Director of Public Instruction, West Bengal, the petitioner's long pending appointment to the post in question should not be deferred any further.
Accordingly, this writ petition is disposed of with a direction upon the college to issue the appointment letter in favour of the petitioner within a period of one month from the date of communication of this order, subject to compliance with the other formalities. Accordingly, WPA 19867 of 2023 is disposed of.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
