The number of the writ petition in the cause title of the order dated January 17, 2023 has been wrongly typed as W.P.A. 20950 of 2022 instead of WPA 20950 of 2021.

Department is directed to carry out the necessary correction as indicated above in the said order, as well as in the certified copy of it, if already supplied to the parties, on production of the same. Other portions of the said order shall remain unaltered.

The father of the petitioners was a Group-D employee of Kantakhali Puthia High School, District : Murshidabad. He retired from his said service on superannuation on December 31, 2010 and died subsequently.

The petitioners alleged that the retiral benefits of their father have not been released.

This Court vide order dated January 17, 2023 directed the concerned District Inspector of Schools

(S.E.), the respondent no.3 herein to take necessary steps for redressal of the grievance of the petitioners. Mr. Chattopadhyay, learned senior Government Advocate appears and submits that such steps have already been taken and relevant papers have been forwarded to the concerned Treasury Officer with a request to release the admissible retiral dues of the father of the petitioners.

Mr. Halder, learned Advocate for the petitioners submits that the petitioners on February 09, 2023 have submitted all the relevant papers from their end to the said Treasury Officer.

Considering the aforesaid development, the said Treasury Officer is directed to release the retiral dues of the father of the petitioners immediately in accordance with law.

The concerned Treasury Officer shall also consider whether the petitioners are entitled to any interest for the delayed payment.

Copy of the report of the District Inspector of Schools and the copy of the letter under which the petitioners have submitted relevant documents to the said Treasury Officer be kept with the record. W.P.A. 20950 of 2021 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
