The petitioner, being the owner of a stage carriage, claims to be plying the vehicle from Dubrajpur to Arambagh under a valid route permit.

The petitioner alleges that on July 31, 2024, while the vehicle of the petitioner was plying through the said route, the same was obstructed by the private respondent at around 6.50 a.m. at Karanibandh stoppage and the petitioner as well as his workers were threatened and assaulted. Petitioner lodged a complaint vide a letter, which has been annexed at pages 25-26 of the writ petition which was sent through speed post. Petitioner alleges in-action on the part of the police authorities.

The learned advocate for the private respondents

disputes the submissions made by the learned advocate for the petitioner as well as the allegations leveled against the private respondent in this writ petition.

Learned advocate for the State submits that pursuant to the said complaint a preliminary enquiry was conducted with regard to the allegation of physical assault as well as snatching of mobile phones and cash and after a proper enquiry a prosecution under Section 126 BNSS against the private respondent has been issued vide Bankura P.S. NCR No. 1543 dated August 3, 2024 under Section 126 BNSS. The report of the Inspector-in-Charge dated August 20, 2024 states that the police authorities are keeping a sharp watch and a regular police patrolling is going on in the said locality in order to avoid any untoward incident.

It appears that the grievance raised by the petitioner in this writ petition has been taken care of by the police authorities and action has been taken on the complaint of the petitioner.

With the above observations, the writ petition stands disposed of.
