The innocuous prayer of the petitioner in this case is to grant him leave to file afresh an application for consideration of his prayer for grant of higher pay scale before the District Inspector of Schools, Secondary Education, South 24-Parganas.
The fact remains that the Court has earlier directed the District Inspector of Schools, Secondary Education, Murshidabad to consider the petitioner's prayer as above, by dint of order dated September 7, 2016 in WP 30543(W) of 2014.
Since thereafter, the petitioner has been transferred to a school within the jurisdiction of District Inspector of Schools, Secondary Education, South 24-Parganas and is now working therein. Under such circumstances, Mr. Ali, learned advocate appearing for the petitioner seeks leave that the petitioner may submit his prayer before the present District Inspector of Schools i.e. respondent no. 4.
None appears for the State respondents in spite service of notice.
However, in view of the innocuous prayer of the writ petitioner, the Court finds it proper to dispose of the present case by directing and giving liberty to the writ petitioner to file an application afresh, in terms of his prayer made in the present writ petition, before the respondent no.4/District Inspector of Schools, Secondary Education, South 24-Parganas.
Needless is to mention that so far as the merits of this case is concerned, the Court has not gone into the same and the issues are open for consideration of the respondent no 4, pursuant to the application of the writ petitioner, if any.
It is further directed that the said respondent i.e. respondent no. 4 shall consider and dispose of the petitioner's prayer, if any, within a period of four weeks from the date of submission of the written representation by the petitioner before in its office. The writ petition is disposed of.
Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents.
