This writ petition was filed seeking cancellation of an allegedly unauthorised transfer of name against Consumer I.D. No. 33016165028 in favour of a third party.
During the course of hearing, it has been brought to the notice of the Court by Calcutta Electricity Supply Corporation Ltd. (CESC) that the electricity connection has again already been transferred in the name of the petitioner. This factual position is acknowledged by learned counsel appearing for the petitioner.
However, it is submitted on behalf of the petitioner that, as of now, the electricity supply to the relevant premises stands disconnected, and there is no current supply of electricity.
Learned counsel appearing for CESC Limited submits, on the other hand, that the electricity connection to the premises is active up to the supply point. It is further submitted that the liability of CESC Limited extends only from the meter board to the main switch, and that the connection in question has not been disconnected from their end.
In view of the specific stand taken by CESC Limited, and considering that the meter has already been transferred in favour of the petitioner, this Court finds no reason to keep the writ petition pending. Accordingly, this writ petition is disposed of with liberty to the petitioner to undertake necessary repair work through a licensed electrician/engineer at his own cost.
If, after completion of such repair work, the petitioner still finds that electricity supply has not been restored, it will be open to the petitioner to make an appropriate representation before CESC Limited seeking restoration of the electricity connection. Accordingly, WPA 19875 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
