The grievance of the petitioner is directed against the illegal and unauthorized construction being carried out at the subject premises by the respondent nos. 8 and 9.

It is submitted on behalf of the petitioner that without obtaining any lawful sanction the respondent nos. 8 and 9 are carrying out illegal construction at the subject premises.

On behalf of the State respondents, a Report has been filed on the basis of which it is contended that insofar as the respondent no. 9 is concerned necessary lawful permission has been obtained from the respondent authorities.

In such view of the matter, no further grievance survives.

Liberty is granted to both parties either State authorities and the petitioner to take necessary steps as may be advised in accordance with law insofar as the respondent no. 9 is concerned. The State authorities are directed to consider the representation of the petitioner which was allegedly posted on 31st August, 2022 and dispose of the same in accordance with law within six weeks from the date of communication of this order. It is made clear that there has been no adjudication on the merits of the case and all points are left open to be decided by the respondent authorities in accordance with law. It is reiterated that the only grievance which survives insofar as respondent no. 8 is concerned. No further steps be taken insofar as the respondent 9 is concerned.

In view of the above, as prayed for the time to file a comprehensive representation is extended within a period of seven days from date.

The writ petitioner being WPA 20271 of 2022 stands disposed of.
