This is an application seeking extension of time to surrender before the learned Trial Court.
Liberty is granted to amend the cause title of the connected application.
Learned Counsel appearing on behalf of the petitioner submits as follows. On 18.04.2019, the present revisional application was disposed of with a direction upon the petitioner to surrender before the learned Trial Court within four weeks. However, on 25.04.2019, the West Bengal Bar Council adopted a resolution of pen down by the learned Advocates for the State and the same continued till the date of filing of the application for extension of time being CRAN 1872 of 2019. The application for extension of time was affirmed on 17.05.2019 and was filed in time. Subsequently, due to the onset of the Covid 19 pandemic, the same could not come up for hearing. The petitioner wants to join the proceeding at the earliest. Learned Counsel appearing on behalf of the State, in his usual fairness, submits that it will be in the interest of justice if the accuses/petitioner is directed to surrender before the learned Trial Court at the earliest.
I have heard the submissions of the learned Counsels appearing on behalf of the petitioner and the State and have perused the revision
petition.
It appears that due to a resolution of pen down adopted by the West Bengal Bar Council, the petitioner could not take necessary steps in obtaining a certified copy of this Court's order so as to surrender before the learned Trial Court in time.
In view of the above and in the interest of justice, I direct that the warrant of arrest issued against the present petitioner shall remain stayed for a period of fortnight from this date. The petitioner is directed to surrender before the learned Trial Court within a fortnight from this date. In the event, the petitioner surrenders before the learned Trial Court within such time and prays for bail, his application for bail shall be considered in accordance with law.
With these observations, the application being CRAN 1872 of 2019 is disposed of.
