Mr. Raj Kumar Sain Mr. Sukhendu Banerjee ....for the petitioner Mr. Santimay Bhattacharyya Mr. Ziaul Haque ....for the respondent nos. 7 to 10 Affidavit of service filed on behalf of the petitioner is taken on record.

Despite service, no one appears on behalf of the State, although the petitioner and the private respondents are represented.

Learned counsel appearing on behalf of the petitioner submits as follows. The private respondents had come up with some illegal constructions on public land near the petitioner's property. This is blocking the access to such property.

Accordingly, representation was made on 18.07.2024 before the concerned authorities for taking action in terms of the provisions of the West Bengal Public Land (Eviction of Unauthorized Occupants) Act, 1962. But, the same has not been responded to as yet.

Learned counsel appearing on behalf of the private respondents denies the allegations.

It appears that representation of the petitioner dated 18.07.2024 is pending consideration before the concerned authorities including the Sub-Divisional Officer, Tamluk Sub-Division.

In view of the above, let the respondent no. 3 consider the petitioner's representation dated 18.07.2024 in accordance with law and upon hearing the interested parties as expeditiously as possible, preferably within eight weeks from the date of communication of this order.

It is made clear that the merits of the case have not been gone into.

As affidavits were not called for, the allegations made in the writ petition are deemed not to have been admitted.

With these observations, the writ petition is disposed of.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance.
