The instant memorandum of appeal is filed after 784 days' delay and the appeal is hopelessly barred by limitation. An application under Section 5 of the Limitation Act was filed by the intending appellants/petitioners. However, in spite of repeated opportunity the petitioners are not represented by any Advocate in course of hearing of the application under Section 5 of the Limitation Act.

Mr. Prasun Kumar Datta along with Md. Kutub Uddin and Mr. Santanu Deb Roy appeared on behalf of the State. Since the memorandum of appeal hopelessly barred by limitation and the petitioners have not moved the application under Section 5 of the Limitation Act, the application under Section 5 of the Limitation Act is rejected and in consequence thereof, the memorandum of appeal is also dismissed.
