Learned Counsel for the petitioners submits an earlier criminal case alleging cruelty was registered in 2021. Thereafter impugned criminal proceeding has been registered. 2.
I have gone through the allegations in the impugned FIR/charge-sheet. In the FIR/charge-sheet opposite party no. 2 has disclosed registration of the earlier criminal case. She further alleges on 13.03.2023 at 9:00AM petitioners had come to her parental home and assaulted her. It is also stated due to assault she was medically treated. 3.
There are materials with regard to physical cruelty on opposite party no. 2 in the impugned FIR/charge-sheet. Given this situation, I am not inclined to invoke my inherent power to quash the proceeding.

It is open to the petitioners to agitate his defence at the appropriate stage of the proceeding in accordance with law.

Accordingly, the revisional application is disposed of.

Urgent photostat certified copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Joymalya Bagchi, J.)
