Petitioners seek anticipatory bail.

Learned Advocate appearing for the petitioners submits that the husband was granted anticipatory bail by the jurisdictional Court. He submits that both the petitioners are residence of Mumbai.

Learned Advocate appearing for the State submits that the petitioners are guilty of non-compliance of notices under Section 41A of the Code of Criminal Procedure. He highlights the conduct of the husband subsequent to the grant of anticipatory bail.

So far as the conduct of the husband is concerned, it is open to the State to take appropriate steps as against him. Considering the gravity of the offence and the involvement of the petitioners therein, we grant anticipatory bail to the

petitioners.

Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a Bond of Rs.10,000/- each with two sureties of like amount each to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner no.1 shall meet the Investigating Officer as and when called for till the conclusion of the investigation and petitioner no.2 will co-operate with the investigation and that they shall appear before the jurisdictional Court and pray for regular bail within four weeks from date.

The application for anticipatory bail being C.R.M. 8849 of 2021 is, thus, disposed of.
