For the Respondent No. 7 The grievance of the petitioner is against illegal encroachment upon a portion of the Government land by the private respondent.

The petitioner submitted a representation before the concerned authority pursuant to which several notices were issued to the private respondent to attend the office of the Block Land and Land Reforms Officer for a hearing, but the private respondent did not turn up. The petitioner prays for a direction upon the authority to consider the representation at the earliest.

It is submitted on behalf of the private respondent that the hearing pending before the Block Land and Land Reforms Officer may

be taken up after serving a notice upon the private respondent.

In view of the above, the writ petition is disposed of directing the 5th respondent to consider and dispose of the representation submitted by the petitioner dated 11th September, 2018 within a period of one month from the date of communication of this order after affording reasonable opportunity of hearing to all the interested persons including the petitioner and the private respondent, in accordance with law.

The decision taken by the authority shall be communicated to the parties within a week thereof.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
