21.08.2023 sdas rejected C.R.M.(DB) No. 3268 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Ranaghat Police Station Case No. 594 of 2022 dated 20.08.2022 under Sections 498A/304B of the Indian Penal Code.

And In Re : Bapi Roy .... petitioner Mr. Prabir Majumder Mr. Snehansu Majumder ....for the petitioner Mr. S. G. Mukherji, learned PP Ms. Faria Hossain Mr. Anand Keshari ...... for the State 1.Learned Counsel for the petitioner submits he is in custody for 365 days. He prays for bail.

2. Learned Counsel for the State opposes the prayer for bail and submits victim lady committed suicide within one and half years of marriage. She was pregnant at the time of occurrence.

3. We have considered the materials on record. Statements of witnesses show that the petitioner/husband had demanded dowry. As dowry was not paid wife was subjected to torture and compelled to commit suicide. Allegations against the parents-in-law are not on par with the petitioner. Date has been fixed for consideration of charge. In view of incriminating materials and the nature of offence, we are not inclined to grant bail to the petitioner at this stage.
